Generally, courts of appeals hear cases based on arguments that there were errors in the trial procedure or errors in the judge's interpretation of the law. This includes a trial judge's interpretation of the service of process. Errors by the private process server can be grounds for overturning a judgment, which may be cause for a malpractice suit & complaint against the server.
